Terms and Conditions
- 249 Queens Parade Prop Co Pty Ltd (ACN 651 215 333) in its capacity as trustee of the 249 Queens Parade Property Trust (Rental Provider) has recently introduced the Fitzroy & Co. Rent Free Incentive promotion (Promotion).
- The Promotion will run for a limited time. The Promotion commences at 9am on Wednesday 18 of September 2024 and ends on Friday 28 February 2025 or such earlier date as is determined by the Rental provider (Promotion Period).
- Under the Promotion, subject to these terms and conditions, the Rental Provider may, in its absolute discretion, provide an incentive valued at [up to insert] (Incentive) to eligible tenants (Renter) who enter into a residential tenancy agreement at Fitzroy & Co., 249 Queens Parade, Fitzroy North, VIC, 3068 (Agreement) during the Promotion Period.
- The following terms and conditions apply to the Promotion.
- the term of the Agreement must be at least 12 months;
- the Agreement or any applicable storage and or car parking licence fees it is required to pay to the Rental Provider or its agent from time to time;
- Incentive Distribution:
Option 1: For Incentives valued at $1000 or less, the full amount will be issued within the first week of the term of the Agreement.
Option 2: For incentives exceeding $1000, the amount will be distributed in two parts: the first portion will be issued within the first week of in the term of the Agreement, and the second will be provided during the 26th week of the term of the Agreement; - notwithstanding anything in these Terms & Conditions, the Incentive will not be issued to the Renter until a letter setting out the terms and conditions applicable to the Incentive has been signed by both the Renter and the Rental Provider (Incentive Letter) and the term of the Agreement has commenced;
- if, prior to expiry of the first 12 months of the term, the Agreement comes to an end for any reason other than the reason specified in paragraph (f), the Renter will lose the benefit of any part of the Incentive that remains outstanding;
- if the Agreement comes to an end due to the Renter and the Rental Provider entering into a new residential tenancy agreement in respect of another apartment at Fitzroy & Co. (New Agreement), and the rent payable under that New Agreement is equal to or higher than the rent payable under the Agreement, the Renter will remain eligible for the balance (if any) of the Incentive, which will continue to be payable during the 26th week following the commencement of the term of the Agreement;;
- the Incentive will only apply to the first 12 months of the initial term of the Agreement and will not be available to the Renter in any other circumstances (including in the event the Renter is holding over or in the event the Renter renews the Agreement or enters into a new residential tenancy agreement with the Rental Provider, unless paragraph (e) applies);
- the benefit of the Incentive is personal to the Renter and cannot be assigned by the Renter in the event that the Agreement is validly assigned by the Renter;
- for the avoidance of doubt, the Promotion does not affect the Renter’s obligation under the Agreement to pay the bond and one months rent in advance, or one month’s storage and/or car parking fees in advance, upon executing the Agreement and any ancillary licence. The Incentive may be applied by the Renter to subsequent instalments off Rent and/or licence fees; and
- prior to a Renter’s entry into the Incentive Letter, the Rental Provider may, acting reasonably, cancel, terminate, modify, extend or suspend the Promotion at any time without notice.
