**Brand Partnership Disclaimer**
**1. General Information**
Est Resident Services Pty Ltd ACN 670 713 659 as authorised agent for 249 Queens Parade Op Co Pty Ltd ACN 654 819 735 (“Est.”) facilitates the order of goods (“Goods”) and/or services (“Services”) from third parties (“Third Party Providers”) to residents (“Residents”) of Fitzroy & Co., located at 249 Queens Parade, Fitzroy North, Victoria (“the Building”) through its Resident portal. These terms and conditions apply to orders of Goods and bookings of Services by Residents.
**2. No Endorsement or Warranty**
The inclusion of Third-Party Providers in the Est. Resident portal is for convenience only. The Third Party Providers are independent contractors and are not employees, agents, or representatives of Est..
Neither Est. nor 249 Queens Parade Prop Co Pty Ltd ACN 651 215 333 as owner of the Building (“Owner”) endorse, recommend, or guarantee the quality, safety, legality, or reliability of the Goods and Services provided by Third Party Providers or provide any warranties, express or implied, regarding the Goods and Services, including but not limited to the merchantability, fitness for a particular purpose, or performance of the Goods and Services.
**3. Payment Facilitation**
In some cases, Residents may pay Est. for the Goods and Services, and Est. will pass these funds on to the Third Party Providers. Est.’s role in such transactions is limited to an intermediary facilitating payment and does not constitute an endorsement or guarantee of the Goods and Services. Any disputes regarding Goods and Services or payments must be resolved directly between the Resident and the Third Party Provider.
**4. Release of Liability**
By utilising the Services provided by the Third Party Providers, Residents acknowledge and agree that Est. and the Owner shall not be held liable for any damages, injuries, losses, or other claims arising from or related to the actions, omissions, or conduct of the Third Party Providers. This includes, but is not limited to, any property damage, personal injury, financial loss, delays or failure to deliver Goods or perform Services.
**5. Resident’s Responsibility**
Residents are encouraged to conduct their own research and due diligence before ordering any Goods or engaging the Services of any Third party Provider. It is the Resident’s responsibility to negotiate and agree upon the terms on which the Goods and/or Services will be provided directly with the Third Party Providers.
**6. Governing Law**
These terms and conditions shall be governed by and construed in accordance with the laws of Victoria, Australia. Any disputes arising from or related to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
**7. Acknowledgment**
By utilising the Goods and/or Services provided by the Third Party Providers, Residents acknowledge that they have read, understood, and agree to these terms and conditions.
