Terms and Conditions

  • 249 Queens Parade Prop Co Pty Ltd (ACN 651 215 333) in its capacity as trustee of the 249 Queens Parade Property Trust (Rental Provider) has recently introduced the Fitzroy & Co. Rent Free Incentive promotion (Promotion).
  • The Promotion will run for a limited time. The Promotion commences at 9am on Friday 18th of October 2024 and ends on Saturday 30th November 2024 (Promotion Period).
  • Under the Promotion, subject to these terms and conditions, the Rental Provider will provide a rent free (Incentive) to eligible tenants (Renter) who enter into a residential tenancy agreement at Fitzroy & Co., 249 Queens Parade, Fitzroy North, VIC, 3068 (Agreement) during the Promotion Period.
  • This promotion applies to selected apartments only.
  • The following terms and conditions apply to the Promotion.
  • the term of the Agreement must be at least 12 months;
  • Rent is charged monthly on the first day of each calendar month.
  • The Renter must move in before the 30th November 2024
  • The incentive amount will be provided via a Digital eftpos gift card. The use of the gift card is at the discretion of the renter. If the gift card is not used for the designated incentive, the renter will be responsible for covering the cost of the incentive.

 

Incentive Distribution:

  • Option 1: For incentives valued at $1000 or less, the full amount will be issued within the first week of the renter’s move-in date.
  • Option 2: For incentives exceeding $1000, the amount will be distributed in two parts: the first portion will be issued within the first week of move-in, and the second will be provided during the 26th week of the 12-month tenancy.
  • the Incentive cannot be utilised by the Renter until an agreement setting out the terms and conditions has been signed by both the Renter and the Rental Provider (Incentive Letter) and the renter has commenced their tenancy;
  • if, prior to expiry of the first 12 months of the term, the Agreement comes to an end for any reason other than the reason specified in paragraph (e), the Renter will lose the benefit of any part of the Incentive that remains outstanding;
  • if the Agreement comes to an end due to the Renter and the Rental Provider entering into a new residential tenancy agreement in respect of another apartment at Fitzroy & Co. (New Agreement), and the rent payable under that New Agreement is higher than the rent payable under the Agreement, any part of the Incentive that remains outstanding will be applied to the rent payable under the New Agreement. For the purposes of the Incentive only, the number of payment cycles that have occurred under the Agreement will be deemed to have occurred under the New Agreement;
  • the Incentive will only apply to the first 12 months of the initial term of the Agreement and will not be available to the Renter in any other circumstances (including in the event the Renter is holding over or in the event the Renter renews the Agreement or enters into a new residential tenancy agreement with the Rental Provider, unless paragraph (e) applies);
  • the benefit of the Incentive is personal to the Renter and cannot be assigned by the Renter in the event that the Agreement is validly assigned by the Renter;
  • subject to paragraphs (i) and (j), the terms of the Agreement prescribing the payment of rent during the first 12 months of the initial term of the Agreement are to be read subject to the Incentive Letter;
  • for all other purposes, the terms of the Agreement (including all other Renter obligations to pay other money) will apply and the Incentive Letter must be disregarded. In particular, when construing any provision in the Agreement varying the rent, regard must only be had to the rent payable as specified in the Agreement;
  • for the avoidance of doubt, the Promotion does not affect the Renter’s obligation under the Agreement to pay the bond and one months rent’ Rent in advance upon executing the Agreement; and
  • prior to a Renter’s entry into the Incentive Letter, the Rental Provider may, acting reasonably, cancel, terminate, modify, extend or suspend the Promotion at any time without notice.
  • This offer cannot be used in conjunction with any other offer, promotion, or discount.
